2. Scope of Service
2.1. Services Provided
The App, "Space Plus", owned and operated by Nichcom Go Sdn. Bhd., is an advanced platform designed to facilitate users in locating, accessing, and using Electric Vehicle (EV) charging stations spread across Malaysia.
The central offerings of the App include, but are not limited to:
a. Providing a comprehensive, real-time map of EV charging stations in Malaysia.
b. Allowing users to reserve specific charging ports for their EVs.
c. Facilitating seamless payment for EV charging services through an integrated reload and charge module.
d. Offering two distinct charging methods: 'Time Rate', where the users pay according to the duration of charging, and 'Kilowatt-hour (kWh) Rate', where users pay based on the amount of electricity consumed.
e. Providing real-time updates on the charging status of your EV.
f. Offering customer support for any issues, queries, or concerns related to EV charging.
2.2. User Responsibilities
By availing the services of the App, the user agrees to:
a. Use the App for personal and non-commercial purposes only.
b. Provide accurate, complete, and up-to-date information for the transactions made through the App.
c. Maintain the security of their account information and notify us immediately of any unauthorized use of your account.
d. Comply with all applicable laws while using the App and the associated services.
e. Accept responsibility for all charges incurred under their account.
2.3. Service Availability and Limitations
While we strive to ensure the highest availability and accuracy of services, the App's services are subject to the availability of EV charging stations, the functioning of the EV charging equipment, and the quality of internet connectivity at the user's location.
2.4. Service Modifications
Nichcom Go Sdn Bhd reserves the right to modify, enhance, withdraw, or suspend any part of the App's services without prior notice, at its sole discretion.
2.5. Intellectual Property
All contents of the App, including but not limited to the text, graphics, logos, and software used, are the property of Nichcom Go Sdn Bhd and are protected by international copyright laws.
3. User Obligations
3.1. Information Accuracy
Users are obliged to provide accurate, current, and complete information as required for the purchase of EV charging services through the App. Users also agree to promptly update their personal information whenever necessary to keep it accurate, current, and complete.
3.2. Account Security
Users are responsible for maintaining the confidentiality of their account credentials, and are fully accountable for all activities that occur under their account. In the event of any suspected unauthorized use of an account, users agree to immediately notify us.
3.3. App Usage
Users agree to use the App for lawful purposes only, adhering to all applicable laws, regulations, and rules. Users will not use the App in any way that could harm, disable, overburden, or impair any of our services, or interfere with any other party's use and enjoyment of any services.
3.4. Service Payments
Users agree to promptly fulfill all payment obligations for services availed through the App, according to the stated rates and terms. Users also agree to bear any additional charges or penalties incurred due to late payments, if applicable.
Users agree to accept communication from us through various channels, such as emails, text messages, and in-app notifications, regarding the services of the App, including updates, promotions, and other related messages.
3.6. Violation of Terms
Users understand and agree that any violation of these obligations may lead to immediate termination of service and legal actions against the user as per the applicable laws.
4. Payment Terms
4.1. General Terms
All payments for services availed through the App are to be made using the integrated reload and charge module. We currently accept various forms of payment methods that include but are not limited to credit cards, debit cards, and select digital wallets. The availability of these payment methods may vary.
Users agree to pay all charges incurred in connection with their Space Plus account, including any applicable taxes, at the rates in effect when the charges were incurred. All charges will be billed to the payment method designated during the creation of their Space Plus account.
4.3. Rate Changes
We reserve the right to change the rates and terms of our payment structure at any time without prior notice. If we do make changes, we will post the new rates or terms in the App, and they will apply to your use of the service thereafter.
Except as expressly provided in these Terms and Conditions, all payments made through the App are non-refundable.
4.5. Billing Discrepancies
Users agree to notify us about any billing problems or discrepancies within 60 days after they first appear on your account statement. If users do not bring them to our attention within 60 days, they agree to waive their right to dispute such problems or discrepancies.
4.6. Failed or Declined Payments
In case of a failed or declined payment, we reserve the right to suspend or terminate the user's access to the services provided by the App.
5. Refund Policy
5.1. General Guidelines
All payments made for services availed through the App are generally non-refundable, except under circumstances as described in this refund policy.
5.2. Refund Eligibility
Refunds for services purchased through the App may be issued at our sole discretion under the following circumstances:
a. An error occurred during the charging process directly attributable to a fault or malfunction within our App or network.
b. The user was incorrectly charged due to a system error or a discrepancy in the rate applied.
Please note that refunds will not be provided if the user cannot use the services due to reasons beyond our control, such as the unavailability of an EV charging station or issues related to the user's electric vehicle or payment method.
5.3. Refund Requests
To request a refund, users must contact our customer service team via the provided contact details within seven days from the date of the incident, along with a detailed explanation of the issue and the reason for requesting a refund.
5.4. Refund Assessment
Upon receipt of a refund request, we will conduct an internal investigation to verify the claim. If approved, a refund will be issued using the same payment method used for the original transaction, unless otherwise agreed upon.
5.5. Refusal of Refund Requests
We reserve the right to refuse a refund request if we deem it to be an abuse of our services, or if the user fails to meet the criteria laid out in our refund policy.
6. Deletion Policy
6.1. Account Deletion
Users have the right to delete their Space Plus account at any given time. Upon request for deletion, we will permanently erase all personal data associated with the user's account from our servers. This includes account details, transaction history, and any other personal information previously provided.
6.2. Request Process
To request account deletion, users must contact our customer service team via the provided contact details with a clear statement of their intent to delete their account. The request should come from the email address associated with the user's account to confirm their identity.
6.3. Consequence of Deletion
Once the user's account is deleted, all associated data will be permanently erased, and cannot be recovered. Furthermore, the user will no longer be able to access any services or features offered by the App that require an account. We therefore advise users to carefully consider the implications before requesting an account deletion.
Upon receiving a deletion request, we will process it within 30 days. We will notify the user via email once their account has been successfully deleted.
After deletion, we retain no obligation to store, maintain or provide copies of any content, information, or data that users have posted or uploaded to the App, unless required by applicable laws or regulations.

When you register and use the Space Plus App, we collect personal information that you provide to us, such as your name, email address, phone number, and payment information. We also collect information about your usage of our services, such as your location, charging history, and transaction details.
7.3. Information Usage
We use your information for various purposes, including but not limited to:
a. Providing, maintaining, and improving our services.
b. Processing transactions and sending related information, including confirmations and invoices.
c. Sending technical notices, updates, and support messages.
d. Responding to your comments, questions, and requests, and providing customer service.
7.4. Information Disclosure
We will not disclose your personal information to third parties unless we have your permission or are required by law to do so. We may share your information with third-party service providers to perform tasks on our behalf and to assist us in providing our services.
7.5. Information Protection
We employ reasonable physical, technical, and administrative measures to protect your personal information from unauthorized access, use, or disclosure.

8. Dispute Resolution
Any dispute arising out of the use of the App will be governed by the laws of Malaysia, and shall be settled by the courts of Malaysia.
This Dispute Resolution section applies to any disputes, controversies, or claims (collectively referred to as "Disputes") arising out of or relating to the use of the Space Plus App, the services provided, or these Terms and Conditions.
In the event of any Dispute, the parties agree to first attempt to resolve it by negotiation. This requires the party raising the Dispute to contact the other party through the provided contact details, including a brief, written description of the Dispute and any proposed resolution.
If the Dispute is not resolved through negotiation within 30 days, the parties agree to resolve the Dispute through final and binding arbitration. The arbitration will be conducted in Kuala Lumpur, Malaysia, in English, and in accordance with the rules of the Kuala Lumpur Regional Centre for Arbitration. Each party will bear its own costs of arbitration unless the arbitrator directs that bearing such costs would be an undue burden and in that case, we will pay for your portion of the arbitration administrative costs.
8.4. Governing Law
These Terms and Conditions and any Disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of Malaysia.
If the arbitration agreement in these terms is found not to apply to you or your claim, you agree to the exclusive jurisdiction of the courts of Malaysia to resolve your claim.
9. Modification of Terms
We reserve the right to modify these terms and conditions at any time without prior notice. The most current version of these terms and conditions will supersede all previous versions.
